What is Annual Paid Leave?
Annual paid leave is a paid vacation guaranteed to workers under Article 60 of the Korean Labor Standards Act. A worker with 80% or more attendance over one year accrues 15 days of paid leave. Workers employed less than one year accrue 1 day of paid leave for each month of perfect attendance, up to 11 days. Annual leave is a legal right that protects a worker's right to rest, and employers are obligated to guarantee it.
Leave Days by Years of Service
After 1 year of work, a base of 15 days accrues. For continuous service of 3 or more years, 1 additional day accrues every 2 years beyond the first year, up to a maximum of 25 days. For example, the 3rd year gives 16 days, the 5th year 17 days, and the 21st year and beyond gives 25 days. The additional leave system recognizes tenure and guarantees longer-serving workers more rest.
Using and Expiring Leave
Annual leave accrues yearly and can be used within one year from the accrual date. Unused leave generally expires, but if the employer does not take leave-use promotion measures, leave allowance must be paid for unused leave. Maternity leave, parental leave, and leave for work-related injury or illness are treated as attendance and included in leave calculation.
